| The Code of Hammurabi (1795 - 1750 B.C.) is the
earliest known example of a ruler publicly setting out his laws. It
described the liabilities of the master builder. The master
builder was completely and singularly responsible for the construction
of a building. Penalties for failure of the structure were severe,
even unto execution. |

| Surely, even before the Code was written the
master builder or master mason existed. And the design and
construction of a structure by a single entity (either master builder or
master architect) continued until the 20th century. As technology
developed, specialization fractured the control of the master builder.
Compounding that were laws and regulations intended to "protect the
public," that is the design/bid/build environment.

| In the late 20th century, a number of
alternatives were tried to find a better, faster, lower cost and less
litigious way to deliver building projects. Many are variations on
a theme. Enter the design/build (D/B) delivery method. |

| Without evaluating all of the variations of D/B,
the basic idea is for the Owner to hold a single contract for the design
and construction of a project. The entity that the Owners
contracts with is the D/B. Typically, the D/B is contractor led,
but design led is also common. |

| McCleskey Consulting, Inc., as a design
consultant, has been part of the design build team for several
convention center projects over the last ten years. The term
"team" is, in our opinion, more important in D/B than any other delivery
method. Any deficiency that exists on the completed project must
be compensated within the team. There is high value placed on
competency and cooperation. |

| The Design Build Institute of America (DBIA)
was formed in the early 1990's to encourage the use of the D/B
project delivery method and to develop the skills of the
membership, comprised of Owners, designers and contractors.
Mr. McCleskey is pleased to have earned the DBIA Professional
Designation, one of only few hundred in the US. |
